AUTHORIZATION SERVICE AGREEMENT FOR WI-FI ACCESS
This Authorization Service Agreement for Wi-Fi Access (the Agreement) shall be applied to IP Shibkov P.P. (the Contractor), to the users visiting public Wi-Fi access points (the User) and to the owners of Wi-Fi access points (the Customer). For the purpose of contractual relations between the Customer and the Contractor, the Contractor shall enable the User authorization service using the Authorization Portal (the Portal) when connecting the User to the Wi-Fi network owned by the Customer. The User subscribing to the Portal confirms that the User has read and understood all the provisions of the Agreement, and expresses the consent to provide the Customer with the User’s personal data. Should the User disagree with one or more provisions of the Agreement, or refuse to provide the User’s personal data to the Customer, no authorization is made on the Portal. By signing this Agreement, the User agrees with all its provisions. The User’s consent to enter into this Agreement shall be expressed in form of the User’s actions provided for herein, namely, connection to the Wi-Fi network through authorization, which means unconditional acceptance of the terms of this Agreement.

- 1.Personal data to be collected and stored by the Contractor:
- 1.1. To fully provide services to the Customer, the Contractor shall collect and store the User’s personal data specified by the User, if the latter agrees with the terms hereof..
- 1.2. Personal data to be collected and stored by the Contractor includes the following:
- 1.2.1. The telephone number used to identify the User in the Wi-Fi network, the MAC address of the device through which the User is identified in the Wi-Fi network..
- 1.2.2. The User’s data specified by the User in the social network profile through which the User is authorized, being publicly available subject to the public settings of the social network profile.
- 1.2.3. Technical data, including type and version of the User’s browser, time zone, types and versions of the browser add-on programs.
- 2. Purposes for which the Customer uses the User’s personal data:
- 2.1. The User’s personal data can be used hereunder for the following purposes:
- 2.1.1. For conducting surveys, marketing, statistical and other research.
- 2.1.2. For delivery of ordered/agreed-upon goods and other services to the User.
- 2.1.3. For informing the User about new services or goods of the Customer.
- 2.1.4. For protection of the Contractor’s and the Customer’s interests.
- 3. Disclosure of the Contractor’s personal data to third parties (not being the parties hereto):
- 3.1. Except as provided by law and this Agreement, the Contractor shall not sell, provide for use, exchange or otherwise transfer the User’s personal data to any third parties, without the User’s express consent.
- 3.2. Except as provided by law and this Agreement, the Customer undertakes not to sell, provide for use, exchange or otherwise transfer the User’s personal data to any third parties, without the User’s express consent.
- 3.3. The Contractor shall be entitled to provide third parties with the User’s personal data, if:
- 3.3.1. The User gave an express consent to transfer the personal data to third parties.
- 3.3.2. The transfer of the User’s personal data is necessary to provide services to the Customer and/or to process the User’s personal data. The Contractor requires third parties to respect confidentiality of the User’s personal data, when the Contractor transfers the User’s personal data to third parties.
- 3.3.3. The transfer, use or disclosure of such information is necessary for:
- 3.3.3.1. compliance with any applicable laws and regulations;
- 3.3.3.2. solving and/or eliminating arisen technical problems;
- 3.3.3.3. protection of the Contractor’s interests.
- 3.4. Should the Contractor sell, fully or partially, or otherwise dispose of its assets, all confidentiality obligations in relation to the User’s personal data, provided for herein, shall pass to the recipient of the assets.
- 4. Protection of the User’s personal data.
- 4.1. The Contractor shall take all necessary measures to protect the User’s personal data. However, the User shall be entirely responsible for ensuring security of the devices through which the User logs on to the Internet and the information stored on these devices.
- 4.2. The User confirms and agrees with personal responsibility:
- 4.2.1. For ensuring security of the device (personal computer, mobile device, etc.) through which the User logs on to the Internet;
- 4.2.2. For storage of the following information: passwords, information about accounts, etc.
- 5. The User’s consent to the voluntary provision of personal data to the Contractor
- 5.1. When ordering the Contractor’s services and/or subscribing to the Portal, the User shall explicitly express consent to provide the Contractor and/or the Customer with the User’s personal data for preservation, subsequent processing and use thereof.
- 5.2. By signing this Agreement, the User expresses prior consent to receive any information and service messages from the Customer by any means not prohibited by the law.
- 5.3. The User may terminate this Agreement at any time, provided that the relevant notice is sent to the Contractor 14 days prior to the expected termination.
- 5.3.1. The User may send a notice to the Contractor of the termination of the Agreement by registered mail with declared value and list of enclosures or hand it over personally against receipt to the Contractor’s authorized representative.
- 5.3.2. The Customer shall reserve its right to refuse to provide Wi-Fi access to the User, should the User violate the applicable legal provisions related to communications/mass communications when receiving the relevant access services.
